1. Acceptance of Terms

Welcome to AI Homework Helper ("Application," "App," "Service," "we," "us," or "our"), developed and operated by Jayrajba Chudasama.

These Terms of Service ("Terms") govern your access to and use of the Application, including its artificial intelligence features, educational tools, content, and related services.

By accessing or using the Application, you agree to be bound by these Terms, subject to applicable law.

If you do not agree with these Terms, you should discontinue using the Application.

3. Paid Application and Purchase Terms

AI Homework Helper is distributed as a paid Application through the Apple App Store.

Payment is processed by Apple according to the applicable App Store payment terms.

The purchase price and included functionality are displayed through the App Store and, where relevant, within the Application.

Purchasing the Application grants the user a limited license to use the software, subject to these Terms and applicable Apple usage rules.

3.1 Scope of Purchase

Unless expressly stated otherwise, purchasing the Application does not automatically provide:

Unlimited AI requests.
Unlimited AI model processing.
Guaranteed access to every future feature.
Lifetime availability of third-party AI infrastructure.
Guaranteed uninterrupted online functionality.
Unlimited cloud storage or computational resources.
An advertisement-free experience.

Any limits on AI requests, credits, processing capacity, or other material functionality must be clearly disclosed to users before purchase where required by law.

We will not impose undisclosed restrictions that materially deprive users of functionality they were promised at purchase.

3.2 No Ownership Transfer

Purchasing the Application does not transfer ownership of the Application, its source code, branding, proprietary technology, or intellectual property.

The purchase provides a limited right to use the Application under these Terms.

4. AI Processing Credits and Usage Limitations

AI Homework Helper may depend on third-party artificial intelligence APIs, cloud computing services, processing allowances, and technical usage quotas.

These services may be subject to:

API credit balances.
Request limits.
Token or processing limits.
Rate limits.
Server capacity restrictions.
Temporary provider suspensions.
Third-party billing or infrastructure issues.
Model availability and technical maintenance.

4.1 Third-Party AI Credit Exhaustion

AI services may become temporarily unavailable if the underlying third-party AI provider reaches an applicable processing quota, usage allowance, or credit limit.

We will make reasonable efforts to maintain the resources necessary to deliver the functionality described in the Application.

However, temporary interruptions may occur because of unexpected demand, provider-side restrictions, technical failures, or circumstances outside our reasonable control.

We do not guarantee that third-party AI resources will be available without interruption.

4.2 User-Facing Credits

If the Application provides users with a defined number of AI credits, requests, or usage allowances, the applicable quantity, consumption rules, validity period, and purchase conditions will be disclosed through the Application or relevant purchase interface.

Credits may be consumed when a request is successfully processed, according to the disclosed credit rules.

If a request fails because of a technical error, any credit deduction or restoration will be handled according to the disclosed credit policy and applicable consumer protection requirements.

We will not treat unused paid credits as automatically forfeited unless the applicable terms, purchase disclosures, and law permit that treatment.

We do not guarantee that the Application or its online features will operate continuously, without delays, or without errors.

We may temporarily suspend affected features to investigate technical problems, protect security, or restore service.

We will make commercially reasonable efforts to restore functionality within our control.

To the maximum extent permitted by applicable law, we are not responsible for indirect or consequential losses resulting solely from interruptions outside our reasonable control.

However, this provision does not exclude any mandatory rights to refunds, remedies, or compensation arising from our failure to provide purchased services as legally required.

6. AI-Generated Content Disclaimer

AI Homework Helper uses artificial intelligence to generate educational responses.

Artificial intelligence models may produce content that is inaccurate, incomplete, outdated, misleading, inconsistent, or unsuitable for a particular academic purpose.

We do not guarantee that AI-generated responses will always be correct.

6.1 No Guaranteed Academic Accuracy

Users acknowledge that:

Academic performance depends on multiple factors beyond the Application's control.

6.3 Educational Assistance Only

It is not intended to provide professional medical, legal, financial, or other regulated advice.

Users should not rely on AI-generated responses as the sole basis for decisions involving health, safety, finances, legal rights, or other high-risk matters.

7. User Responsibility and Academic Integrity

Users are responsible for how they use information generated by the Application.

You agree not to:

Use the Application for unlawful activities.
Violate academic integrity rules or examination regulations.
Submit AI-generated work as independently created work where prohibited.
Infringe third-party copyrights or intellectual property rights.
Upload content without the necessary rights or permissions.
Attempt unauthorized access to Application systems.

However, reliance on a third-party provider does not automatically eliminate our responsibility to users for obligations imposed by law or by our contractual commitments.

11. Advertisements

Although AI Homework Helper is a paid Application, it may display advertisements through Google AdMob.

Advertisements may include content, products, or services provided by third parties.

12. Refunds and Purchase Disputes

WE DISCLAIM WARRANTIES THAT MAY LAWFULLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

THE APPLICATION WILL ALWAYS BE AVAILABLE.
AI-GENERATED RESPONSES WILL ALWAYS BE ACCURATE.
THIRD-PARTY SERVICES WILL OPERATE WITHOUT INTERRUPTION.
EVERY SOFTWARE ERROR WILL BE CORRECTED IMMEDIATELY.
THE APPLICATION WILL MEET EVERY INDIVIDUAL EDUCATIONAL REQUIREMENT.
ALL FEATURES WILL REMAIN UNCHANGED INDEFINITELY.

THIS DISCLAIMER DOES NOT EXCLUDE EXPRESS COMMITMENTS MADE AT PURCHASE OR WARRANTIES AND RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JAYRAJBA CHUDASAMA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF, OR INABILITY TO USE, THE APPLICATION.

THIS MAY INCLUDE, WHERE LAWFULLY EXCLUDABLE:

LOST ACADEMIC OPPORTUNITIES.
LOSS OF EXPECTED GRADES OR EDUCATIONAL OUTCOMES.
LOSSES ARISING FROM RELIANCE ON INCORRECT AI-GENERATED INFORMATION.
INDIRECT LOSSES CAUSED BY THIRD-PARTY SERVICE OUTAGES.
INDIRECT LOSSES ASSOCIATED WITH TEMPORARY API OR PROCESSING LIMITATIONS.
LOSS OF EXPECTED BENEFITS FROM SERVICE INTERRUPTIONS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE APPLICATION SHALL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT PAID BY THE USER FOR THE APPLICATION AND RELEVANT PAID SERVICES DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR

(B) THE MINIMUM AMOUNT OF LIABILITY THAT APPLICABLE LAW REQUIRES OR DOES NOT PERMIT US TO EXCLUDE.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE WHERE SUCH LIMITATION IS PROHIBITED, OR ANY OTHER LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED.

MANDATORY STATUTORY RIGHTS AND REMEDIES REMAIN UNAFFECTED.

17. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless the developer against third-party claims, damages, and reasonable expenses directly arising from your unlawful use of the Application, infringement of third-party rights, or material violation of these Terms.

This obligation applies only to the extent that the relevant claim is attributable to your conduct.

It does not require you to indemnify the developer for the developer's own unlawful conduct, negligence, or breach of obligations where such an arrangement would be unenforceable.

18. Force Majeure

We will not be responsible for delays or failures in performance to the extent directly caused by extraordinary events beyond our reasonable control, including:

Widespread internet outages.
Major infrastructure failures.
Government restrictions.
War or civil emergencies.
Large-scale cybersecurity incidents.
Unexpected disruption of essential third-party infrastructure.

This provision applies only to the extent permitted by law and does not eliminate any mandatory refund, consumer protection, or other statutory rights.

19. Suspension and Termination

Users may stop using the Application at any time.

Deleting the Application does not automatically reverse a completed purchase or erase information held by third-party service providers.

Termination does not affect accrued legal rights or obligations that are intended to survive termination.

20. Children's Use

Children and minors must use the Application in accordance with applicable age requirements, parental consent rules, and App Store restrictions.

23. Apple App Store Provisions

The following provisions apply to the Application's distribution through Apple's App Store.

23.1 Acknowledgement

These Terms are between the user and Jayrajba Chudasama, not Apple.

The developer is responsible for the Application and its content, subject to applicable law.

23.2 License

Users receive a limited, non-exclusive, non-transferable license to use the Application on Apple-branded devices they own or control, as permitted by Apple's applicable usage rules, including authorized Family Sharing or volume purchasing arrangements.

23.3 Maintenance and Support

The developer is responsible for Application maintenance and support to the extent specified in these Terms or required by applicable law.

Apple has no obligation to provide maintenance or support services for the Application.

23.4 Product Warranty

The developer is responsible for applicable product warranties to the extent they cannot lawfully be disclaimed.

If the Application fails to conform to an applicable warranty, the user may notify Apple, and Apple may refund the purchase price in accordance with the applicable Apple licensing terms.

To the maximum extent permitted by law, Apple has no further warranty obligation regarding the Application.

23.5 Product Claims

The developer, rather than Apple, is responsible for addressing claims relating to the Application, including applicable product liability, legal compliance, and consumer protection claims.

23.6 Intellectual Property Claims

In the event of a third-party claim that the Application infringes intellectual property rights, the developer, rather than Apple, is responsible for the investigation, defense, settlement, and discharge of such claims, to the extent required by applicable law and Apple's terms.

23.7 Legal Compliance

Users represent that they are not located in a country subject to applicable United States government embargo restrictions and are not listed on applicable United States government prohibited or restricted party lists.

23.8 Third-Party Terms

Users must comply with applicable third-party agreements, including wireless data service terms, when using the Application.

23.9 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of the applicable end-user license terms and may enforce those provisions against users as provided under Apple's requirements.

24. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be limited or severed to the extent necessary.

The remaining provisions will continue in effect to the extent legally permissible.

25. No Waiver

Failure to enforce a particular provision does not constitute a waiver of the right to enforce that provision later.

Nothing in these Terms is intended to exclude or limit rights that cannot lawfully be excluded or limited.
